PICK OF THE LITTER 2008 OFFICIAL CONTEST RULES

NO PURCHASE NECESSARY TO ENTER OR WIN.  MAKING A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

THIS PROMOTION IS INTENDED FOR PARTICIPATION IN THE UNITED STATES ONLY, AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW.

1. HOW TO ENTER:  Beginning at 12:00 a.m., EST on March 18, 2008 through 11:59 p.m., EST on March 27, 2008, official entry forms will be published in the Times Herald-Record and online at www.recordonline.com, and will also be available at the Times Herald-Record main lobby at 40 Mulberry Street, Middletown, N.Y. during regular business hours.   Entry forms must be mailed to: Pick of the Litter Contest, Times Herald-Record, Circulation Department, PO Box 550, Middletown, N.Y. 10940.   Entrants are required to fill out the entry form in its entirety, including pet owner’s name, pet name, address, phone number and e-mail address.  A photo of the pet being entered, must accompany the entry form.  Color or black/white photos are accepted. Photos will not be returned, and become the property of the Times Herald-Record. Photos must be a minimum of 3”x 5” in size. All entries for the contest must be received by 12:00 p.m. on Tuesday, March 27, 2008. Only one photo entry per pet.  Any pet photo entered multiple times in violation of the preceding entry limitation will be disqualified.  Sponsor is not responsible for late, lost, misdirected, or ineligible entries that are not timely received or are lost due to computer or electronic malfunction or other error.  Along with your entry form, you may include a $10 donation to the Times Herald-Record’s Newspapers in Education program.  This donation is voluntary and in no way impacts your chances of winning the contest.

2. WEEKLY ROUNDS:  All first-round entrants will be published in the Times Herald-Record on Tuesday, April 8, 2008.  Readers will vote for their favorite pet photos.  The contest will run for four rounds.  The first round will commence on Tuesday, April 8, 2008. All votes for the first round must be submitted by 5:00 p.m. on Thursday, April 17, 2006.  Round One winners/Round Two qualifiers will be announced in the newspaper on Tuesday, April 22, 2008. All votes the second round must be submitted by 5:00 p.m. on Thursday, May 1, 2008. Round Two winners/Round Three qualifiers will be announced in the newspaper on Tuesday, May 6, 2008. All votes for the third round must be submitted by 5:00 p.m. on Thursday, May 15, 2008. Round Three winners/Round Four qualifiers will be announced in the newspaper on Tuesday, May 20, 2008. All votes for the fourth round must be submitted by 5:00 p.m. on Thursday, May 29, 2008. First, second, third, fourth and fifth place winners will be announced the in the newspaper on Tuesday, June 3, 2008. Voting ballots will be available in the newspaper, at the Times Herald-Record Middletown lobby, 40 Mulberry St. during regular business hours, and online at www.recordonline.com.

3. VOTING: All photo entries received by the March 27 deadline will be displayed online at www.recordonline.com.  Viewers may vote for their favorite pet photo. Online voting will take place between April 1, 2008 and April 3, 2008. One vote per person, per day will be allowed. The 175 pets with the most votes will advance to Round 1 of the contest, and will be published in print in the Times Herald-Record on April 8, 2008. In each round, 1 through 4 the first vote is FREE and subsequent votes may be submitted for a charge of $.25 per vote. One free vote per person per round. No photocopies accepted. All voting charges go to support the Times Herald-Record’s Newspapers in Education Program (NIE). Voting fees & donations will be accepted via credit card over the phone, by calling 845-346-3257. Voters may also mail ballots, fees & donations to: Pick of the Litter Contest, Times Herald-Record, Circulation Department, P.O. Box 550, Middletown, NY 10940.  Ballots, fees & donations may also be dropped off at the Times Herald-Record main lobby at 40 Mulberry Street in Middletown during regular business hours.  Voters may submit multiple votes.  Votes are not consecutive. Voting starts over with each round.  Contestants with the lowest numbers of votes will be eliminated each round until the final round. The fifth round will announce the Pick of the Litter winners. The entries receiving the most votes, as determined by the Times Herald-Record in its sole discretion, shall win first, second, third, fourth and fifth place prize packages.  The number of submitted entries and votes per round determines odds of winning.

4.  ELIGIBILITY: Orange, Sullivan, Ulster and Dutchess Counties in New York, Pike County, Pennsylvania, or Sussex County, New Jersey, who are 18 years of age or older at the time of entry, and who already have access to the Internet as of the date the sweepstakes is first advertised. Void where prohibited by law. Employees (including immediate family members and/or those living in the same household of each) of Sponsor and its affiliates and subsidiaries, advertising and promotion agencies and prize suppliers are not eligible. This contest is subject to all applicable federal, state and local laws. The laws of the United States govern this promotion.  People who have won a Times Herald-Record prize in the last 60 days are not eligible.  All entries must have a complete name, address, and phone number for contact. 

5. PRIZES:  Prize packages will be awarded to the first, second, third, fourth and fifth place winners, as determined at the end of Round 4. A complete description of the prize packages is available online at www.recordonline.com. ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER.  The potential winner forfeits the prize if not claimed within seven days of first attempted notification, whether notification is by e-mail, regular mail or telephone, or, if after reasonable attempts are made, notification is unsuccessful.  In such event, the prize will be awarded to an alternate winner.  Prize is not transferable, except at discretion of Sponsor.  No substitution of prize by winner, but in the event of unavailability, Sponsor will substitute a prize of approximately equal value. The prize is awarded WITHOUT WARRANTY OF ANY KIND from Sponsor, express or implied, without limitation.  Entrants agree to be bound by the terms of these official rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this contest.  Sponsor reserves the right to change prizes and prizes will be awarded in random order.

6.  REQUIRED DOCUMENTS:  Potential prize recipients may be required to sign and return an Affirmation of Eligibility and Liability and Publicity Release within 14 days following the date of first attempted notification.  Failure to comply will result in forfeiture of prize and award to an alternate winner. 

7.  CONDITIONS OF PARTICIPATION: By entering, participant agrees to their name and town/location being published in the event that they are a winner. Acceptance of a prize constitutes permission for Sponsor to use winner’s name, likeness, photograph and/or voice for advertising and promotional purposes without additional compensation, unless prohibited by law.  Entrants further grant Sponsor the right to use and publish their proper name and state of residence online, in print and any other media in connection with this contest.  By entering, participants release and hold harmless Sponsor, its parent, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with participation in this contest or acceptance or use of prizes.

8.  LIMITATION OF LIABILITY.  By entering the contest, entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or in connection with the contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the contest, but in no event attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

9.  CONSTRUCTION.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and Sponsor, shall be governed by, and construed in accordance with the laws of the state of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of New York, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than New York.  The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision.  In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

10. INDIVIDUAL ENTRY ONLY. Each entry must be submitted only by the entrant, and only by mail to: Pick of the Litter, Times Herald-Record, Circulation Department,  PO Box 550, Middletown, N.Y. 10940, or submitted to the drop box in the lobby of the Times Herald-Record at the above address. Entries submitted by any other form, including but not limited to commercial sweepstakes or contest subscription notification or entering service sites, will be declared invalid and, as such, ruled ineligible for this promotion.

11.  TAMPERING; TECHNICAL PROBLEMS.  The contest shall be void and Sponsor shall have no responsibility or liability therefore if, for any reason, the contest is not capable of running as planned, whether due to print difficulties, scheduling conflicts, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest. Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes.  Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft or destruction or unauthorized access to, or alteration of, entries.  Sponsor is not responsible for any problems or technical malfunctions.   CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
